Packaging2U.MY e-Commerce platform is run by Starflex Packaging Sdn. Bhd. and its affiliates and affiliates (hereinafter referred to as the “Packaging2U.MY“, “we” or “our“).
Packaging2U.MY Terms & Conditions (this “Agreement”), governs the goods ordering (the “Order”) and the use of Packaging2U.MY e-Commerce platform (“Services”) between Packaging2U.MY and you or the person who initial the goods purchase (“Client” or “You” or “Your“).
CUSTOMER AGREES THAT IT SHALL DEFEND, INDEMNIFY, SAVE AND HOLD Packaging2U.MY HARMLESS FROM ANY AND ALL DEMANDS, LIABILITIES, LOSSES, COSTS AND CLAIMS, INCLUDING REASONABLE ATTORNEY’S FEES ASSERTED AGAINST Packaging2U.MY, ITS AGENTS, ITS CUSTOMERS, OFFICERS AND EMPLOYEES, THAT MAY ARISE OR RESULT FROM ANY SERVICE PROVIDED OR PERFORMED OR AGREED TO BE PERFORMED OR ANY PRODUCT SOLD BY CUSTOMER, IT’S AGENTS, EMPLOYEES OR ASSIGNS. CUSTOMER AGREES TO DEFEND, INDEMNIFY AND HOLD HARMLESS Packaging2U.MY AGAINST LIABILITIES ARISING OUT OF; (1) ANY INJURY TO PERSON OR PROPERTY CAUSED BY ANY PRODUCTS SOLD OR OTHERWISE DISTRIBUTED IN CONNECTION WITH Packaging2U.MY’S e-commerce platform; (2) ANY MATERIAL SUPPLIED BY CUSTOMER INFRINGING OR ALLEGEDLY INFRINGING ON THE PROPRIETARY RIGHTS OF A THIRD PARTY; ( 3) COPYRIGHT INFRINGEMENT AND (4) ANY DEFECTIVE PRODUCTS SOLD TO CUSTOMER FROM Packaging2U.MY’S e-commerce platform.
Packaging2U.MY WILL NOT BE RESPONSIBLE FOR ANY DAMAGES YOUR BUSINESS MAY SUFFER. Packaging2U.MY MAKES NO WARRANTIES OF ANY KIND, EXPRESSED OR IMPLIED FOR SERVICES WE PROVIDE. Packaging2U.MY DISCLAIMS ANY WARRANTY OR MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. THIS INCLUDES LOSS OF DATA RESULTING FROM DELAYS, NON-DELIVERIES, WRONG DELIVERY, AND ANY AND ALL SERVICE INTERRUPTIONS CAUSED BY Packaging2U.MY AND ITS EMPLOYEES. Packaging2U.MY RESERVES THE RIGHT TO REVISE ITS POLICIES AT ANY TIME WITHOUT PRIOR NOTICE.
In no circumstance will Packaging2U.MY be liable for any claims resulting from the use or inability to use Packaging2U.MY’S e-commerce platform – including, but not limited to, service interruptions, client errors, Internet connectivity problems, miscommunications, unauthorized access to Packaging2U.MY’S e-commerce platform, InterNIC problems, DNS caching, Internet bandwidth congestion, power failures, vandalism, and natural disasters or act of God.
